Terms of Service
Last updated May 14, 2026. These terms govern your use of TomsIndex websites, APIs, search, cached answers, extraction, hints, dashboards, and related services.
1. Agreement
By creating an account, using an API key, submitting a URL, calling an endpoint, or otherwise using TomsIndex, you agree to these Terms. If you use TomsIndex for an organization, you represent that you are authorized to bind that organization.
2. Accounts and API keys
You are responsible for your account, credentials, API keys, and all activity under them. Keep API keys confidential, use reasonable security controls, and notify us if you believe a key has been compromised. We may rate-limit, suspend, revoke, or refuse service to protect TomsIndex, other users, or third parties.
3. Data we collect and use
We may collect and process account information, API keys and prefixes, submitted URLs, search queries, prompts, coding tasks, extraction inputs, generated outputs, feedback, logs, usage metrics, approximate request metadata, and billing or plan information.
We use this data to operate, secure, monitor, debug, improve, abuse-protect, cache, rank, evaluate, and bill for TomsIndex. We may also use aggregated, de-identified, or derived data to improve search quality, cached answers, hints, extraction, ranking, evaluations, and related models or systems.
Do not submit secrets, regulated personal data, private content, or confidential third-party information unless you have the rights and authority to do so.
4. Content and permissions
You retain ownership of content you submit. You grant TomsIndex a worldwide, non-exclusive, royalty-free license to host, copy, process, crawl, index, analyze, transform, display, cache, and transmit submitted content and related outputs as needed to provide and improve the service.
You represent that you have the rights needed for anything you submit, including URLs, prompts, tasks, feedback, and files. You are responsible for the legality, accuracy, and consequences of your use of TomsIndex outputs.
5. Acceptable use
You may not use TomsIndex to break the law, violate third-party rights, bypass access controls, scrape or extract content you are not permitted to access, distribute malware, overload infrastructure, spam, evade rate limits, abuse authentication, or interfere with the service.
6. Third-party content and outputs
Search results, extracted pages, cached answers, hints, links, snippets, metadata, and generated outputs may be incomplete, outdated, inaccurate, offensive, unavailable, or subject to third-party rights and terms. You should verify important information before relying on it.
7. Fees and plans
Free, paid, and verified plans may have quotas, limits, feature restrictions, or rate limits. We may change plans, pricing, limits, or features prospectively. You are responsible for taxes and charges associated with your use where applicable.
8. No warranties
TomsIndex is provided "as is" and "as available." We do not promise that the service will be uninterrupted, secure, error-free, accurate, complete, or fit for a particular purpose.
9. Limitation of liability
To the maximum extent permitted by law, TomsIndex and its operators will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost data, business interruption, or loss of goodwill.
To the maximum extent permitted by law, our total liability for any claim relating to TomsIndex will not exceed the amount you paid to TomsIndex for the service giving rise to the claim during the three months before the event giving rise to liability, or $100 if you paid nothing.
10. Indemnity
You agree to defend, indemnify, and hold TomsIndex and its operators harmless from claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys' fees, arising from your use of the service, your content, your violation of these Terms, or your violation of law or third-party rights.
11. Changes and termination
We may update these Terms from time to time. Continued use after an update means you accept the updated Terms. We may suspend or terminate access at any time, including for abuse, legal risk, nonpayment, security concerns, or violation of these Terms.
